Paris Hilton may face a max of 90 days in jail if she was found violating her probation.

“She’s potentially in violation of probation; we are taking steps to verify this,” L.A. city attorney spokesman Frank Mateljan tells PEOPLE.

Paris Hilton was stopped Tuesday at 11pm on Sunset blvd for speeding and driving without headlights on.

Paris was cited for driving with a suspended license a misdemeanor violation. She was driving a 2007 Bentley Continental GTC Convertible.

She was on her way back from buying DVD’s in West Hollywood and didn’t notice her lights not on because she had just left a highly lit parking area.
